These Terms and Conditions constitute a legally binding agreement between you and VehicleInsure. By accessing our website, using our services, or purchasing an insurance policy, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Definitions

In these Terms and Conditions:

  • "VehicleInsure," "we," "us," "our" refers to VehicleInsure Nigeria Limited, a company registered in Nigeria with RC Number 1234567.
  • "You," "your," "user" refers to the individual or entity using our services.
  • "Policy" means the insurance contract between you and the underwriting insurance company.
  • "Premium" means the amount payable for insurance coverage.
  • "Services" includes our website, mobile application, insurance brokerage, and related services.
  • "NAICOM" means the National Insurance Commission of Nigeria.

2. Acceptance of Terms

By accessing or using our services, you confirm that:

  • You have read and understood these Terms and Conditions
  • You agree to be legally bound by these terms
  • You will comply with all applicable laws and regulations
  • You accept our Privacy Policy and Cookie Policy

If you do not agree to these terms, you must not use our services.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into a binding contract
  • Be a resident of Nigeria or have a vehicle registered in Nigeria
  • Provide accurate and complete information
  • Not be prohibited from receiving insurance services under Nigerian law

4. Account Registration

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information promptly
  • Keep your login credentials confidential and secure
  • Notify us immediately of any unauthorized account access
  • Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

5. Insurance Services

5.1 Role of VehicleInsure

VehicleInsure acts as an insurance broker/intermediary connecting customers with licensed insurance underwriters in Nigeria. We are not an insurance company and do not underwrite policies directly.

5.2 Policy Terms

All insurance policies are subject to the specific terms, conditions, exclusions, and limitations contained in the policy document. You must read your policy document carefully.

5.3 Duty of Disclosure

You have a legal duty to disclose all material facts that may influence an insurer's decision to accept the risk or determine the premium. Failure to disclose material facts may result in policy cancellation or claim denial.

5.4 Policy Issuance

Insurance coverage begins only after:

  • Full premium payment is received
  • The policy is accepted and issued by the underwriter
  • All required documentation is complete

6. Premiums & Payments

  • Premiums must be paid in full before coverage commences
  • All payments are processed in Nigerian Naira (₦)
  • We accept payment methods as displayed at checkout
  • Installment plans are subject to approval and may incur processing fees
  • Late payments may result in policy cancellation
  • Premium rates are subject to change upon renewal

7. Claims Process

7.1 Notification

You must notify us of any incident that may give rise to a claim:

  • Immediately for theft or total loss
  • Within 24 hours for accidents
  • Within 7 days for other incidents

7.2 Documentation

You must provide all requested documentation including:

  • Completed claim form
  • Police report (where applicable)
  • Photos of damage
  • Repair estimates
  • Any other documents reasonably requested

7.3 Cooperation

You must cooperate fully with our claims investigation, including allowing vehicle inspection and providing access to relevant information.

8. Cancellation & Refunds

8.1 Cancellation by You

You may cancel your policy at any time. Refunds will be calculated on a pro-rata basis for the unexpired period, less an administration fee of ₦2,500, provided no claims have been made.

8.2 Cancellation by Us

We reserve the right to cancel your policy for:

  • Non-payment of premium
  • Fraud or misrepresentation
  • Breach of policy terms
  • Regulatory requirements

8.3 Cooling-Off Period

New policies have a 14-day cooling-off period during which you may cancel for a full refund (minus administrative fees) provided no claims have been made.

9. Intellectual Property

All content on our website and mobile application, including text, graphics, logos, images, software, and trademarks, is the property of VehicleInsure or its licensors and is protected by Nigerian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

10. Prohibited Activities

You agree not to:

  • Provide false or misleading information
  • Use our services for fraudulent purposes
  • Attempt to circumvent our security measures
  • Use automated systems to access our services
  • Interfere with other users' enjoyment of our services
  • Violate any applicable laws or regulations

11. Limitation of Liability

To the maximum extent permitted by Nigerian law:

  • VehicleInsure's liability is limited to the value of the insurance policy premium paid
  • We are not liable for indirect, consequential, or punitive damages
  • We are not liable for acts or omissions of third-party insurance underwriters
  • We do not guarantee uninterrupted or error-free service

12. Indemnification

You agree to indemnify and hold harmless VehicleInsure, its directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms and Conditions
  • Your violation of any law or third-party rights
  • Fraudulent or negligent acts by you

13. Dispute Resolution

13.1 Negotiation

Parties shall first attempt to resolve disputes through good-faith negotiations.

13.2 Mediation

If negotiation fails, disputes shall be referred to mediation at the Lagos Multi-Door Courthouse (LMDC).

13.3 Arbitration

If mediation fails, disputes shall be settled by arbitration under the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria, 2004. The arbitration shall take place in Lagos and be conducted in English.

13.4 Insurance Ombudsman

You may also refer complaints to the Nigerian Insurance Ombudsman Bureau.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. The courts of Lagos State shall have exclusive jurisdiction over any disputes.
